State Question 780 – Drug Reform

November 8, 2016 Oklahomies will have the opportunity to overhaul part of our defective criminal justice system. State Question 780, if adopted, will create an amendment to Title 63 O.S. § 2-402 and treat ALL simple drug possession as a misdemeanor, regardless to the number of times a person is arrested and charged. That is right – ALL (cocaine, meth, heroin, LSD, PCP, opiates, marijuana, etc). Is this a solution to our defective criminal punishment system?

Maybe. But, there needs to be punishment enhancements for people who habitually use drugs like meth that create a danger to society and refuse treatment.  Currently, we spend millions of dollars incarcerating people who need substance abuse help or like to party on the weekends instead of rehabilitating them so they can contribute to their families/society. My philosophy as a prosecutor in Tulsa County was rehabilitation, not incarceration and this is an opportunity to try another avenue.
